Terms of Service

These Terms of Service ("Terms") govern your access to and use of the NovaConsulting and NovaConsulting Admin mobile applications, website, and related services (collectively, the "Services") provided by NovaConsulting ("we", "us", or "our"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Service

NovaConsulting provides a platform that connects care facilities and businesses with health providers (nurses, carers, support and related staff) for the posting, matching, assignment, and management of shifts and tasks, including rosters, timesheets, payslips, and invoices.

2. Eligibility and Accounts

• You must be at least 18 years old and legally able to enter into a contract.
• You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Acceptable Use

You agree not to:

• Use the Services for any unlawful, fraudulent, or harmful purpose;
• Misrepresent your identity, qualifications, or availability;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems;
• Upload content that is unlawful, infringing, or that you do not have the right to share.

4. Health Providers and Businesses

Health providers are responsible for holding and maintaining any qualifications, registrations, and clearances required for the work they accept. Businesses are responsible for the accuracy of the shifts and tasks they post and for their compliance obligations. NovaConsulting provides the platform but is not a party to the employment or engagement arrangements between businesses and health providers unless expressly agreed in writing.

5. Location Sharing

The health-provider app offers optional location sharing during active shifts to support coordination and dispatch. You control this feature and may disable it at any time. Use of location data is described in our Privacy Policy.

6. Payments

Payments, payslips, allowances, and invoices processed through the Services are subject to the arrangements between the relevant businesses and health providers and to applicable law. You are responsible for the accuracy of timesheets and related records you submit.

7. Intellectual Property

The Services, including all software, text, and design, are owned by NovaConsulting or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Services for their intended purpose. You retain rights in the content you submit, and grant us the rights needed to operate the Services.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the fullest extent permitted by law, NovaConsulting will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services.

10. Termination

We may suspend or terminate your access to the Services at any time for conduct that violates these Terms or that we reasonably believe is harmful to other users, us, or third parties. You may stop using the Services at any time.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
